Bankruptcy

The firm represents parties in connection with all aspects of chapter 11 or chapter 7 bankruptcy cases arising out of a distressed business enterprise, including the distressed business itself or its shareholders, officers, directors, or creditors, adverse parties in litigation, creditors committees, or potential purchasers of a bankruptcy debtor or its assets. Whether in advising and advocating for a business contemplating a reorganization or liquidation through bankruptcy or in assisting someone reacting to the bankruptcy filing of another party, the firm has the tools and experience necessary to represent any party in connection with any aspect of the bankruptcy process. The firm limits its bankruptcy debtor representations to those of business entities or individuals whose debts consist primarily of business-related debts.

Workouts

Bankruptcy is only one of several options available to a troubled business looking for the best method for reorganizing or liquidating its business or financial affairs or for a guarantor looking to protect assets from a loan deficiency; because each situation is unique, often, bankruptcy may not be the best solution. The firm helps each client understand all of the non-bankruptcy options available and the burdens and benefits of each, whether an out-of-court debt restructuring, some other workout solution, or civil litigation (including guaranty defense). Fiduciary Representation

The firm routinely represents bankruptcy trustees, state court receivers, and federal equity receivers in discharging their duties in accordance with law and in a manner that maximizes recoveries for all constituencies. Firm member A. Cotten Wright currently serves as a member of the panel of chapter 7 bankruptcy trustees for the Western District of North Carolina. Mr. Grier has acted as a Future Claimants Representative in the asbestos bankruptcy arena. In addition, the firm has extensive experience liquidating failed “Ponzi scheme” ventures, whether in U.S. District Court, U.S. Bankruptcy Court, or in North Carolina state court.
